Legislative Demands

The North Carolina NAACP and the Forward Together Moral Movement are deeply concerned by the extremist policies being developed in the NC Legislature, and the anti-democratic direction that the General Assembly is taking during the 2017 Legislative Session.

The legislative provisions coming from the General Assembly are not only regressive and immoral, they constitute an unprecedented power-grab by the House and the Senate. Over the course of a few months, the legislative branch has shown that it is in the business of representing its own interests, as opposed to the interests of the people of North Carolina. The General Assembly continues to spend taxpayer dollars in defending these unconstitutional legislative provisions in the courts.

To add insult to injury, the General Assembly advancing these anti-people decisions, are illegitimately occupying elected offices. Last year, a federal district court found that 28 legislative districts were racially gerrymandered and unconstitutional. The court ordered the legislature to redraw the districts and hold a special election, but again the General Assembly continues to delay and has appealed its unconstitutional actions to the Supreme Court. Until the districts are redrawn without racial bias, and a fair election is held, members of the current NC General Assembly continue to illegitimately hold power. A special election in 2017 must take place to redress this anti-democracy, unconstitutional racially gerrymandered redistricting process and restore our democracy.

Today, we call on our legislators to work in the best interests of the people, and to abide by the spirit and the dictates of Article 1, Section 2 of the NC Constitution which states: “All political power is vested in and derives from the people. All government of rights originates from the people and is founded upon their will only and his instituted solely for the good of the whole.”

WE DO NOT SUPPORT THE LEGISLATIVE COUP

Repeal SB 2 and SB 4 | SB 4 limits the people’s access to the Supreme Court in an effort to reduce the influence over the newly progressive-leaning court. It also restructured the State and County Board of Elections in an effort to reduce responsibilities previously held by the Governor’s office, and to ensure partisan control over future elections. SB 2 continues to infringe on gubernatorial powers and the voters choices by reducing the Governor’s appointment powers.

Vote Against HB 239, HB 240, and HB 241 | These bills undermine the judicial branch and continue to divert power from the executive and judicial branch to the legislative branch. HB 239 reduces the Court of Appeals from 15 to 12 judges. HB 240 and 241 take the District Court and Superior Court judge appointment powers from the Governor and gives them to legislature.

Vote Against HB 193 | HB 193 extends Senators’ terms from 2 years to 4 years.

Vote Against the Veto Override of HB 100 | HB 100 makes trial court judgeships partisan.

WE SUPPORT LEGISLATION THAT FURTHERS THE PEOPLE’S AGENDA 5 THEMES

#1: WE SUPPORT LEGISLATION WHICH WILL secure pro-labor, anti-poverty policies that ensure economic sustainability by fighting for employment, living wages, the alleviation of disparate unemployment, a green economy, labor rights, affordable housing, targeted empowerment zones, strong safety net services for the poor, fair policies for immigrants, infrastructure development and fair tax reform.

Repeal HB 405 | HB 405 makes it illegal to be a whistleblower and to expose injustice at a place of employment.

Full Repeal of HB 2 | HB 2 strips local governments of the ability to raise the minimum wage and pass other ordinances that benefit working people.

Vote Against SB 75 | SB 75 caps the income tax rate which will benefit the rich while hurting the public good.

Support legislation that will increase the minimum wage to $15 an hour.

#2: WE SUPPORT LEGISLATION WHICH WILL promote educational equality by ensuring every child receives a high quality, well-funded, constitutional, diverse public education as well as access to community colleges and universities and by securing equitable funding for minority colleges and universities.

Repeal SB 39 | SB 39 shrinks the UNC Board of Governors from 32 to 24 people.

Vote Against HB 251 and SB 204 | These bills allow concealed guns to be carried on college campuses.

Vote For HB 13 | HB 13 provides greater flexibility in class sizes and would prevent mass teacher layoffs in programs such as art, music, physical education, and languages.

Support legislation to increase teacher pay, charter school regulation, and decrease private school vouchers.

#3: WE SUPPORT LEGISLATION WHICH WILL provide healthcare for all by ensuring access to the Affordable Care Act, Medicare and Medicaid, Social Security and by providing environmental protection.

Vote Against HB 62 and HB 63 | HB 62 and 63 attack women’s reproductive rights.

Support legislation to expand Medicaid coverage to nearly 500,000 North Carolinians who lack access to life-saving health care and legislation to support under-resourced rural hospitals.

#4:  WE SUPPORT LEGISLATION WHICH WILL create fairness in the criminal justice system by addressing the continuing inequalities in the system and providing equal protection under the law for black, brown and poor white people.

Repeal HB 972 | HB 972 made police body-cam footage inaccessible to the public.

Vote Against HB 249 | HB 249 criminalizes people utilizing their First Amendment right by defining an economic boycott as “economic terrorism”, a Class H felony, and by reducing consequences for injuring a protester with a car.

Vote For HB 233 | The “Ban the Box” bill will help formerly incarcerated individuals get a second chance in life.

Vote For HB 280 | The “Juvenile Justice Reinstatement Act” raises the age from 16 to 18 at which someone will be treated as adults in the criminal justice system.

#5: WE SUPPORT LEGISLATION WHICH WILL protect and expand voting rights, women’s rights, LGBT rights, immigrant rights and the fundamental principle of equal protection under the law.

Fully Repeal HB 2 | In addition to the anti-worker components, HB 2 brazenly discriminates against transgender people and reduced the access of anyone within a protected group, including veterans, people of color, women, and people with disabilities, to file discrimination claims in state court.

Vote Against HB 306 and HB 35 | These bills hurt immigrant communities by restricting municipalities and public universities from becoming sanctuary cities and schools and increasing the likelihood of deportations.

Vote For HB 303 | The “Voter Freedom Act” helps protect North Carolina voters from being improperly challenged during the 25 days before an election.

Support legislation to give North Carolinians fair and unabridged access to the ballot box and restore fair democracy in North Carolina by holding a special election in 2017 to redress the unconstitutional redistricting of 2011, and supporting a fair redistricting process free of racial bias and partisan bias in 2020.
